About Home Detention Orders

A Home Detention Order is a sentence where an offender is required to be at a specified premise, during specified times and to comply with strict conditions, including electronic monitoring.

Home Detention is made for a specific period of time, not exceeding 18-months.

Order Conditions

Offenders under Home Detention Orders are required to:

  • live at the address approved by the Court and remain there at all times except when they have permission to leave
  • wear an electronic monitoring device (fitted to their ankle) subject to 24/7 monitoring
  • not commit another offence
  • allow a Police Officer or Probation Officer to enter their home at any time
  • allow a Police Officer to search their person or home at any time, and take a sample of anything they find
  • follow all reasonable directions from their Probation Officer
  • take tests to see if they have been using alcohol or drugs if directed to do so by a Probation Officer or Police Office
