About Court Mandated Diversion
The Court Mandated Diversion (CMD) program is available as a sentencing option in Tasmania.
CMD provides Magistrates and Judges with an option to divert eligible offenders into treatment for their drug or alcohol use.
CMD aims to break the drug and alcohol crime cycle by providing offenders with access to the services and treatment necessary to address the issues that contribute to their drug and alcohol use and offending.
Following a plea or finding of guilt, suitable individuals can be diverted into drug or alcohol treatment through sentencing to a Drug and Alcohol Treatment Order (DATO). A Magistrate will review the individual's progress during the order. A DATO is an intensive community based sentence as part of a custodial sentence.
Before sentencing to a DATO, the Court must request an assessment report from Community Corrections. The report will take into consideration eligibility and suitability factors.
Information sheets
If the court makes a DATO, they must specify whether the order is being made in respect of the illicit drug use or alcohol dependency of the offender. Community Corrections manages offenders accordingly, with information contained in the below information sheets:
