How are fines converted to a community service order

Under Section 47(2) of the Sentencing Act 1997, unpaid fines may be converted to community service if the Magistrate orders.

The court will ask Community Corrections to assess if any or all of the outstanding amount can be paid, and whether the offender is suitable for a Community Service Order.

For every $100.00, or part thereof, seven hours of community service is ordered. For example:

  • $95.00    = 7 hours
  • $135.00  = 14 hours
  • $199.00  = 14 hours
  • $201.00  = 21 hours

There is no limit to the number of hours that can be ordered under this section of the Act.

It is possible for a person to make payments that will reduce the hours outstanding on a community service order. Refer to Section 48(6) of the Sentencing Act 1997.
