Information Collection Notice

The personal information, including sensitive information, provided by you is collected and will be used in accordance with the requirements of the Personal Information Protection Act 2004 (the PIP Act), together with the Department of Justice’s Personal Information Protection Policy.

By providing information, you agree to the Department of Justice collecting any personal, sensitive or health information you provide.

The information you provide the Department will be used for the purposes of administering the Historical Forced Adoption Redress Scheme including giving you (or your nominated support person) more information, communications, or updates about the Historical Forced Adoption Redress Scheme. The information you provide will be made available to authorised staff of the Department of Justice, any other agency of the Tasmanian Government, government agency of any other state, territory, or the Commonwealth government, and any other parties only for these purposes.

You can access and correct the information you provide. If you would like to access or correct the information you have provided, please email us at HFARS@justice.tas.gov.au. If you do not provide us with the information required in this application form, we may not be able to assess your eligibility for the Historical Forced Adoption Redress Scheme.

We only collect personal information where it is reasonably necessary to perform our functions and, with your consent, will only use this information for the purpose for which it was provided, unless another lawful basis applies.

Under Tasmania’s Right to Information Act 2009 (the RTI Act), information that would disclose the personal details of someone other than the RTI applicant is generally protected from release. Such information may only be disclosed if, after applying the public interest test, disclosure is not contrary to the public interest. If an RTI application is received for information about the Historical Forced Adoption Redress Scheme that might cover your information, you will be consulted before a decision is made, and have rights of review.

Separately, under the PIP Act, individuals have the right to request access to their own personal information held by the Department of Justice, subject to limited legal exceptions.
