Stages in the court process

A person is either arrested and charged at the time of an incident, or sent a document that sets out the charges against them. They have to appear in court at a date set by the court. The charge will be read out and the accused may plead guilty or not guilty immediately or ask for the case to be postponed (adjourned).

If the offender pleads guilty the Magistrate can sentence them immediately or adjourn the case to another date for sentencing.

Sentencing is the decision made by the Magistrate and may include a fine, community service, the direction to attend a program or an undertaking of good behaviour, or time in prison.
