Issuing a Search Warrant (in person)

  1. Verify Applicant’s Identity
    • Ask the police officer for identification or badge number.
  2. Review the Application
    • Ensure it includes the following details:
      1. Applicant’s name, rank, station and badge number
      2. Description of the place to be searched
      3. Name of the occupier (if known)
      4. Brief description of the offence
      5. Type of evidence sought
      6. Reason for suspicion
      7. Previous search warrants (if any)
      8. Officer responsible for execution
      9. Period of validity (max 28 days)
      10. Execution time (specific hours or any time)
      11. Conditions for seizing additional evidence
      12. Conditions for searching persons
      13. Full names and birthdates of all involved
  3. Ask Clarifying Questions
    • Ask about the reliability of the source, prior use of the source, details on premises and suspects, previous warrants, and specifics of the search.
  4. Swear or Affirm the Application
    • Ensure the applicant swears or affirms the truth of the application.
  5. Witness the Applicant’s Signature
    • Sign the application and endorse with your JP registration number.
  6. Complete and Verify the Search Warrant
    • Ensure it includes:
      1. Applicant’s details, date issued, and premises to be searched
      2. Occupier’s details (if known)
      3. Validity period and execution time
  7. Sign and Endorse the Search Warrant
    • Sign the warrant and include your JP registration number.
    • You can ask police for a copy of the application.
  8. Record Keeping
    • It is recommended to keep personal records of all search warrants issued in a secure, lockable location.
