Applications for Restraint Orders
- Administer oath or affirmation
- As a JP, administer the necessary oath or affirmation for the application, depending on who is filing the application.
- Affidavit from the respondent (if applicable)
- If the respondent wishes to defend the application, administer an oath or affirmation for their affidavit.
- Affidavits from other relevant persons (if applicable)
- Administer an oath or affirmation for any other affidavits filed by persons whose evidence is relevant to the case.
- Court decision
- Understand that the decision to make an interim or final restraint order is made by the court based on the evidence presented.
