Parole Board Decision

In the matter of the Corrections Act 1997

and

In the matter of an Application for Parole by Andrew John NICHOLS

27 April 2007

Reason for Decision

On 27 April 2006 the Applicant was convicted of manslaughter and 4 counts of perverting the course of justice in the Hobart Supreme Court.

The Applicant was sentenced to 3 years imprisonment with a non-parole period of 18 months.

The Applicant became eligible to be released on parole on 27 April 2007.

In considering the application for parole the Board has taken into account the statutory criteria which it is required to do pursuant to the Corrections Act 1997.

The Board has also taken into account the following information when assessing the Applicant’s application for parole:

1. Comments made by Justice Slicer when passing sentence

2. A pre-parole report prepared by his probation officer dated 28 February 2007.

3. An addendum to the above report dated 24 April 2007.

4. The Applicant’s prison record, which can be described as very good.

5. The Board notes the Applicant has good prospects of employment on release.

6. The Board notes that the Applicant has suitable accommodation and the support of his family.

7. The Board further notes the Applicant has made an effort to complete an apprenticeship whilst in prison.

8. The Board has taken into account letters written to the Board including a statement by a victim.

Taking all matters into account, the Board is of the view that the Applicant now meets the statutory criteria to be granted parole and that his reintegration into the wider community will best be served by the Applicant being granted a period of parole.

A condition attaching to the Applicant’s release will be that that he not enter licensed premises during the parole period.
