Parole Board Decision

In the matter of the Corrections Act 1997

and

In the matter of an Application for Parole by Shane Phillip West

22 May 2006

Reason for Decision

The applicant is presently in custody in relation to the following offences:

(a) Aggravated Armed Robbery(5 counts)

(b) Attempted Armed Robbery (5 counts)

In relation to the above offences the applicant was sentenced to a period of imprisonment of 12 years and 6 months. The applicant was eligible to be considered for parole on the 14 July 2004.

The applicant’s earliest release date from prison is 8 September 2011.

The Board has been provided with documentation, which fully outlines the circumstances surrounding the offences committed by the applicant.

The Board has been advised by the Victims Assistance Unit that a victim is registered in relation to the applicant but did not wish to place materials before the Board.

In considering the applicant’s application for parole the Board has taken into account the relevant statutory criteria, which it is required to do so pursuant to the Corrections Act 1997.

The Board has taken the following matters into account when assessing the applicant’s application for parole:

(a) The comprehensive pre parole report prepared by the applicants probation officer

(b) The applicants prior convictions

(c) The applicants prison record

The applicant has prospects of employment upon a farm when released from prison. He will reside on the property.

The applicants offending occurred as a result of a gambling addiction. The applicant has sought assistance whilst in prison for his addiction. The applicant has made contact with Gabba and will seek continued assistance from that organisation upon his release from prison.

The Board is of the view that the applicant’s prospects of reoffending are minimal if he maintains contact with Gabba and continues to seek assistance in relation to his gambling addiction.

The Board is of the view that the applicant meets the statutory criteria to be granted parole.
