Parole Board Decision

In the matter of the Corrections Act 1997

and

In the matter of an Application for Parole by Nathan Michael William Streets

22 September 2006

Reason For Decision:

 On 12 November 2004 the applicant was granted parole in relation to a number of offences.

The applicant appeared before the Board on 10 April 2006 as a result of returning a positive drug test to cannabis.

At that time the applicant had full time employment. The Board suspended the applicants parole from 13 April until 15 April so that he would not loose his employment.

The applicant again appeared before the Board on 8 September 2006.

Once again the applicant had returned a positive reading to cannabis. On that occasion the applicant denied having consumed cannabis. He asserted that he had been in the company of others who had used cannabis. He asserted that the positive test to cannabis occurred as a result of him passively inhaling the cannabis.

On that date the Board revoked the applicant’s parole.

The Correction’s Act 1997 places no prohibition upon a prisoner immediately reapplying for parole after their parole has been revoked.

The applicant made an immediate application for parole.

The Board was provided with a pre parole report from the applicant’s probation officer.

At the time the applicant’s parole was revoked he held full time employment. The applicant’s employer speaks highly of him .The applicant’s employer had held his position open for him. His employer indicated that if the applicant’s application for parole was unsuccessful he would need to fill the position held by the applicant.

The applicant is a married man with a dependant child. Other than the positive tests to cannabis the applicant’s behaviour whilst on parole had been satisfactory.

In the circumstances the Board was of the view that the applicant remaining in full time employment would assist him in successfully reintegrating into the community. As such he should be granted a further period of parole.
