Reason for Decision

(GIVEN ORALLY UPON HEARING APPLICATION)

CHAIRMAN: We are going to grant you parole. Parole will be granted on and from the 23rd December 2003.

I am obliged to give you reasons why the Board has granted you parole. As you are aware you were convicted of murder on the 23rd September 1998, and you were sentenced to 10 years imprisonment.

The sentencing Judge at the time noted that sometimes basically decent people’s senses are dulled and distorted and they do, or commit acts that wouldn’t normally be expected of them and that are totally out of character.

We take into account the fact that you did have a good record before this, certainly no criminal record and the Judge thought that the commission of this offence this was completely out of character and, presumably judging by the low sentence he gave you, he thought there was some very mitigating circumstances.

Two of the factors we must consider are the likelihood of the prisoner re-offending and also the protection of the public. We are heartened by the comments made by the Judge and your previous good record but we also note that the psychiatric report from Mr Saxby- Pridmore dated the 20th November 2003 which ranks you as a low risk of ever re-offending and from our observation we concur with that view.

We note that suitable arrangements have been made upon your release from prison; in that you have accommodation provided by the Salvation Army, which fits your needs.

We take into account your physical disabilities. We note that because of your physical injury you are probably not likely to work and you have been granted a disability pension and that is probably the best that will ever happen to you as far as future work is concerned so it’s not a question of us considering whether or not you’re likely to get a job in the future. We also note that you have a good record in prison. You have complied with all the requirements placed upon you whilst in prison so we doubt that we will ever see you return to prison.

You will be released on parole on the 23rd December, 2003 and remain on parole until the 11th November, 2007.
