Parole Board Decision

In the matter of the Corrections Act 1997

and

In the matter of an Application for Parole by Andrew Darrell Legge

8 April 2005

Reason for Decision

Mr Legge, we have considered your application for parole. We are going to grant you parole from the 19th April 2005. The comments made by Mr McKee, the chairman of the parole board on the 24th September 2004 when you were granted parole remain apposite and we are essentially giving you parole for the same reasons.

Since we gave you parole on the 24th September 2004 of course you lapsed and you breached your conditions of parole and that’s why we’re here today. Considering all the circumstances, we think a period of four months in prison that you will serve by the time of your release, is sufficient warning to you that parole is to be taken seriously and the effects of breach of parole can have on you. As said in your pre-parole report of the 24th March 2005 as a result of the revocation of parole you have lost your employment; lost the confidence of your family; and you lost the ability to attend medical treatment.

The future is in your hands. If you want to breach your parole you will again serve a period of imprisonment. As Mr Kemp pointed out it will be a lot longer than the three to four months that you’re going to serve as a result of this lapse.

We will grant you parole again and we will hope that you have learnt your lesson as to what can happen when you breach parole. You will be released as of the 19th April.
