Court Mandated Diversion

How To Enter The Program

To be accepted into the CMD program a defendant must first undergo assessment to determine whether they are eligible and suitable for the program.

A Magistrate can refer an offender to assessment after a plea or finding of guilt and before deciding upon sentence.

If a defendant would like to be considered for the program they should tell their lawyer or they may also tell the Magistrate when they appear in Court.

Consent

The CMD program is based on consent. This means that the agreement of the defendant is required before their assessment and before their treatment. If a person agrees to an assessment and to participate in the program, they will also be asked to provide consent for the sharing of relevant information between Assessors, Case Managers and Court Diversion Officers.
