What if a condition of a community service order is broken?

A community service order is a serious penalty and if any of the conditions of the order are broken an offender can be charged and taken back to court.

In some instances when an offender breaks a condition of the order they will be given another chance and given a warning.

For each offence an offender is convicted of they are liable under Section 36(4) of the Sentencing Act 1997 to:

  • a fine of up to $1000.00
  • imprisonment, actual or suspended, for up to three months
  • a Probation Order
  • more Community Service Order hours
  • a combination of any of the above

In addition to receiving a penalty for breaking their order, any outstanding hours can be cancelled and the offender may be re-sentenced on the offences for which they originally received the Community Service Order.
