How to register a Deed of Relationship

You will need to:

• complete an Application to Register a Deed of Relationship [PDF]
• pay the prescribed fee
• provide appropriate identification

Note:  If you are registering a Caring Relationship you must lodge with your Application, a Certificate of Legal Advice - Caring Relationship [PDF] (one certificate for each person).

This is to be completed by a legal practitioner.

The legal practitioner will advise each party of the legal ramifications of registering a caring relationship.

What happens after I lodge the application to register a Deed of Relationship?

After the lodgment of the application to register a Deed of Relationship, the Registrar of Births, Deaths and Marriages will consider the application and may require additional information from the applicants.

If the application is in order the Registrar will register the deed.  Registration will be refused if either party withdraws, if either party is married or either party is party to another Deed of Relationship.

When will the Deed of Relationship be registered?

The deed cannot be registered until 28 days after the application has been lodged.  Until the deed is registered the Registrar may seek additional information from the parties and either party may withdraw the application.

How to withdraw an application to Register a Deed of Relationship

You can withdraw your application to Register a Deed of Relationship at any time during the 28 day period between lodging your application and the registration being finalised by:

• completing a Withdrawal of Application to Register a Deed of Relationship form [PDF]
  
• providing appropriate identification

There is no fee payable for withdrawing your application. However, the original payment for lodging the Application to Register a Deed of Relationship is not refundable. If you wish to re-apply you will need to submit a new application.
