Policy for Access to Register Entries
Access to Birth Records
Historical
Birth records are unrestricted after 100 years.
Family
- Registered person.
- Registered parent.
- Non-parental custodian or guardian. Documentary evidence required to establish legal custody or guardianship.
- Child of registered person. Documentary evidence of relationship required i.e. birth certificate, custody or guardianship order.
- Spouse or registered partner or registered person. Documentary evidence of relationship required i.e. marriage certificate or relationship certificate.
- Grandparents. Must produce written authority of a parent or non-parental legal custodian or guardian.
- Other persons - Documentary evidence required to establish relationship. Pre-adoption birth records are open to the biological mother and child with authorisation under Section 80 of the Adoption Act 1988 (form 17).
Welfare
- Government or non-government welfare agency acting in interests of the registered person.
- Access by missing person tracing services, such as the Red Cross and Salvation Army, are treated under the Registrar's discretionary powers.
Estate Matters
Executor, Administrator or Public Trustee. Applicants must name the testator or intestate deceased.
Law Enforcement
- Police (State or Federal) or National Crime Authority in pursuance of an investigation or preparation of a prosecution or pursuant to a valid warrant or court order.
- Other "law enforcement" agencies may be allowed access on approval by the Registrar.
Consular
Consular Office or foreign legation of the country of origin of the registered person or of one of the parents.
Statutory
Any government body having right of access under Commonwealth or Tasmanian Legislation. Restricted to formal investigation. Agreements as to how information is to be provided or for what cost may be entered into by the Registrar.
Implied Agent
Solicitor or conveyancer acting for a person entitled to access under "Family Access" or "Access for Estate Matter". Documentary evidence required.
Other Agent
Any person with written authority from, or power of attorney of, a person entitled to access under "Family Access" or "Access for Estate Matter". Documentary evidence required.
Access to Death Records
Historical
Death records are unrestricted after 25 years.
Family
- Spouse or registered partner. Documentary evidence of relationship required if person not named on death record.
- Registered parents. Documentary evidence of relationship required if person/s not named on death record.
- Non-parental custodian or guardian. Documentary evidence of relationship required.
- Children. Documentary evidence of relationship required if person not named on death record.
- Brother, sister or next of kin if deceased has no surviving spouse, children or parents. Documentary evidence of relationship required.
- Other persons. The death certificate of a deceased child is open to the biological mother with authorisation under Section 80 of the Adoption Act 1988 (form 17).
Welfare
- Government or non-government welfare agency acting in interests of next of kin of registered person.
- Access by missing person tracing services, such as Red Cross and Salvation Army, are treated under the Registrar's discretionary powers.
Benefit
Insurance or credit company, superannuation or trust fund. To enable payment of benefits, direct or indirect, to next of kin or other beneficiary.
Estate Matters

Access to Marriage Records
Historical
Marriage Records are unrestricted after 75 years.
Family
- Registered person.
- Child of the marriage. Documentary evidence of relationship required.
- Child of one party to the marriage who has an authorisation under Section 80 of the Adoption Act 1988 (form 17).
Welfare
- Government or non-government welfare agency acting in interests of registered person or a child of the marriage.
- Access by missing person tracing services, such as Red Cross and Salvation Army, are treated under the Registrar's discretionary powers.

- Access by missing person tracing services, such as the Red Cross and Salvation Army, are treated under the Registrar's discretionary powers.
Estate Matters
Executor, Administrator or Trustee. Applicants must name the Testator or intestate deceased.
Law Enforcement
- Police (State or Federal) or National Crime Authority in pursuance of an investigation or preparation of a prosecution or pursuant to a valid warrant or court order.
- Other "law enforcement" agencies may be allowed access on approval by the Registrar.
Consular
Consular Office or foreign legation in the case of a relationship of one of the parties country of origin.

Any government body having right of access under Commonwealth or Tasmanian Legislation. Restricted to formal investigation. Agreements to how information is to be provided or for what cost may be entered into by the Registrar.
Implied Agent
Solicitor or any person with written authority from, or power of attorney of, a person entitled to access under "Family Access" or "Access for Estate Matter". Written, signed authority from the registered person to make application on their behalf is required. Must be acting for one of the parties of the relationship.
Medical
A medical organization or government body requiring to contact one of the parties to the relationship. Evidence of necessity (such as a declaration detailing the need for registered information) is required.
